Smarty Hathi – Terms of service

1. Introduction

Welcome to “Smarty Hathi”, a mobile game developed and published by “Two Triangles Technology Pvt. Ltd.” (“we,” “us,” or “our”). By accessing or using “Smarty Hathi” (“the game” or “games”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not access or use the Game.  

2. Use of the Game

  • Eligibility: You must be at least 3 years old to access and use the Game.
  • License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Game for personal, non-commercial purposes.  
  • Restrictions: You agree not to:
    • Use the Game for any illegal or unauthorized purpose.
    • Modify, adapt, translate, or reverse engineer any portion of the Game.
    • Remove any copyright, trademark, or other proprietary rights notices from the Game.
    • Use any unauthorized third-party software or hardware with the Game.
    • Attempt to gain unauthorized access to the Game or any related systems or servers.
    • Interfere with or disrupt the operation of the Game.
    • Use any cheats, hacks, or exploits in the Game.
    • Impersonate any person or entity, or falsely claim an affiliation with us.
    • Collect or use any personal information of other players without their consent.
    • Violate any applicable laws or regulations.

3. In-App Purchases

  • Availability: The Game may offer optional in-app purchases (e.g., virtual currency, items, subscriptions).
  • Billing: All in-app purchases are processed through the Google Play Store. You are responsible for any applicable taxes and fees associated with your purchases.
  • Refunds: In-app purchases are generally non-refundable. However, you may be eligible for a refund in limited circumstances under the Google Play Store refund policy.

  • Ownership: All rights in and to the Game, including but not limited to all copyrights, trademarks, trade secrets, and other intellectual property rights, are owned by us or our licensors.

THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE GAME OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.  

7. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR THE GAME, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold us harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or relating to your use of the Game, your violation of these Terms, or your violation of any rights of any third party.

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Game or by other reasonable means. Your continued use of the Game after the effective date of any such changes constitutes your acceptance of the new Terms.
